Minutes: The Licensing Sub-Committee noted the procedure to be followed when considering Licensing Applications under the Licensing Act 2003. The Chair introduced the members of the Sub-Committee and the Officers present at the hearing.
The Chairman confirmed that the Officer’s report relating to the case, the procedure to be adopted during the hearing and the documents which the authority was required to provide under the Regulations had been received by all Parties in advance of the meeting. |

Decision: The Sub-Committee has considered the following applications for Temporary Event Notices (TEN) from Michael Krzyzanowski in relation to the Great Lyde Public House, Yeovil (the Applicant):
· 14 June 2024 to 16 June 2024: the sale of alcohol and live music from 12:00 to 23:00; and
· 19 June 2024 to 25 June 2024 the sale of alcohol and live music from 12:00 to 23:00; and
· 29 June 2024 to 2 July 2024 the sale of alcohol and live music from 12:00 to 23:00; and
· 5 July 2024 to 7 July 2024 the sale of alcohol and live music from 12:00 to 23:00; and
· 9 July 2024 to 10 July 2024 the sale of alcohol and live music from 12:00 to 23:00.
The Sub-Committee heard from the Specialist Licensing Officer, the Applicant, Environmental Protection and Avon & Somerset Constabulary (the Police).
The Sub-Committee have considered the objections made by the Police and Environmental Protection. However, they were mindful that the Applicant could hold the event without the licensable activities that had been applied for and felt that the granting of the TENS ensured there were better measures in place for the event to satisfy that the licensing objectives would not be undermined.
The Sub-Committee accordingly approved and confirmed five TEN applications. Minutes:
The Chairman explained that due to the nature of some of the information that needed to be considered regarding security arrangements for the events that the Sub-Committee would go into confidential session.
It was proposed and seconded to exclude the press and public from the meeting.
RESOLVED: That in accordance with Section 100A(4) of the Local Government Act 1972 (as amended), the press and public be excluded from the meeting in view of the likely disclosure of exempt information as described in Schedule 12A to the Act, i.e. information relating to the financial or business affairs of any particular person (including the authority holding that information).
The Sub-Committee followed the procedure set out in the agenda annex.
There were no questions to the Licensing Specialist.
Representatives for Environmental Health and the Police presented their cases in objection to the application. The representatives responded to questions and points of clarification from members. The Licensing Specialist and Legal Specialist also provided advice to members regarding the existing premises licence.
The applicant presented his case to the Sub-Committee, and all parties were given the opportunity to question the applicant. The applicant answered questions put to him and provided details on points of clarification raised.
All parties confirmed that they were satisfied with the conduct of the hearing.
All parties withdrew , with the exception of the Legal Specialist and the Democratic Services Officer, leaving the Sub-Committee to consider its decision.
Members of the Sub-Committee considered their decision in private session and were mindful of the advice given to them by the Legal Specialist.
Upon reconvening (in open session), the Chair announced the decision of the Sub-Committee. This was given verbally to the applicant. A full Decision Notice would be sent to the applicant following the hearing.
