    The Chairman introduced herself and her fellow Sub-Committee Members, Officers and the Legal Advisor then explained their roles. As well as acknowledging the documents she explained the procedure to be followed during this meeting of the Sub-Committee.

     

    The Licensing Officer introduced his previously circulated report.  The hearing was to consider an application to grant a Premises Licence under the Licensing Act 2003 for Porlock Bay Oysters/the Oyster Shed, Ship Stables, Porlock Weir Minehead.

     

    Detailed in the Officer’s report were the recommendations for the subcommittee to take such steps as it considered appropriate for the promotion of the four licensing objectives, being:

     

    ·       The prevention of crime and disorder;

    ·       The prevention of public nuisance;

    ·       Public safety;

    ·       The protection of children from harm

     

    The steps the sub-committee may take are to:

     

    ·       Grant a premises licence subject to conditions identified in the applicant’s operating schedule/agreed position (modified to such extent as the authority considers appropriate for the promotion of the licensing objectives) and any appropriate mandatory conditions;

    ·       Grant a premises licence subject to variations to the licensable activities and or timings proposed in the application, or to propose additional conditions relevant to the four licensing objectives;

    ·       Reject the application;

     

    The following comments and points were presented by the Interested Party in relation to their written objections:-

    (summarised)

     

    ·       The primary objection to the alcohol licence was for the outside seating area only, there was no objection to the inside area. The outside seating area was directly adjacent to the interested parties business and domestic dwelling with potentially 24 people using the area;

    ·       Concerns regarding noise and light pollution in the Courtyard;

    ·       Concerns with the effects on the Exmoor National Park;

    ·       There should not be a Licence for outdoor seating and daytime should be up to 6pm;

    ·       Concerns that there were no public lavatories on site and patrons would need to use the public lavatories across the road from the site causing noise and nuisance;

    ·       Concerns on the effects of the neighbouring Hotel business;

    ·       The proposed 6pm Licence was not reasonable as the business needed to maximise its potential;

     

     

    The following comments/questions were raised by the Sub-Committee of the Licensing Officer;

    ·       Clarification on whether the business was closed for the winter period; the business would rely on online sales in the winter and open for adhoc events;

    ·       Concerns with the lack of lavatories on the premises for staff and customers;

    ·       The licence should be for 9.30pm for the outside seating area to protect near be residence from noise and light pollution;
